  1. Acceptance of Terms By accessing or using www.talrizio.com (the “Service”), operated by Talrizio, a California-based entity (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Service.
  2. Changes to Terms We may revise these Terms at any time. We will post the revised Terms here and update the “Last updated” date. Material changes will become effective 30 days after posting (or as required by law) for California residents.
  3. Eligibility You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this age requirement.

Binding Arbitration & Class Action Waiver Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service shall be resolved exclusively by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except as modified herein.

  • Arbitration will take place in San Diego, California (or via video/phone if you prefer).
  • There is no judge or jury in arbitration, and court review is limited.
  • YOU AND WE BOTH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION.

30-Day Opt-Out Right (California Residents Only) California residents may opt out of this arbitration agreement by sending written notice within 30 days of first accepting these Terms to: Talrizio

The opt-out notice must include your full name, address, and a clear statement that you are opting out of arbitration.

  1. Governing Law These Terms shall be governed by the laws of the State of California, without regard to conflict of law principles.
  2. California Section 1542 Waiver If we settle any dispute with you, you agree that the following waiver applies: You hereby waive California Civil Code § 1542 (or any similar law), which states: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”
  3. California Consumer Complaints Under California Civil Code § 1789.3, California users are entitled to the following notice: You may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
  4. Limitation of Liability (California-adjusted) TO THE MAXIMUM EXTENT PERMITTED BY CALIFORNIA LAW, in no event shall our total liability to you for all damages exceed the amount you paid us in the 12 months prior to the claim (or $100 if no payment was made).
  5. Unclaimed Property If we owe you money and are unable to contact you, California law may require us to deliver unclaimed funds to the State of California after a certain period.
